By accessing or using our website, you agree to be bound by these Terms. 1. About Us The Still Point is an independent, non-commercial print and digital literary publication published by The Still Point Press, based in London, United Kingdom. We publish short fiction, poetry, essays, and visual art. We do not process payments directly, nor do we store payment or shipping information. All payments for contest entries and physical print orders are processed by third-party Merchant of Record services. 2. Intellectual Property & Copyright Published Content: All literary work and visual art published by The Still Point remains the intellectual property of their respective authors and artists. Rights Granted: Unless agreed otherwise in writing (e.g., for Prize Cycles), authors grant The Still Point exclusive First World Publication Rights (in print and digital formats) for a period of six (6) months from the date of initial publication, alongside non-exclusive ongoing archival rights. Following this period, all rights revert to the author, provided that any subsequent publication or reprint acknowledges The Still Point as the original publisher. Site Materials: The design, branding, logo mark, and underlying code of this website are protected by copyright and trademark laws and may not be reproduced or used without prior written permission. 3. Machine Learning, Data Mining, and Scraping Prohibition Text and Data Mining (TDM) Opt-Out: In accordance with UK and EU copyright legislation, we explicitly reserve all rights regarding Text and Data Mining (TDM). This reservation applies to all content published on this website, including prose, poetry, and visual art. Automated extraction, scraping, crawling, or harvesting of any prose, poetry, visual art, or text from this website for any purpose—including the training, fine-tuning, or development of machine-learning models, artificial intelligence systems, or data collection sets—is strictly prohibited without an explicit, signed licensing agreement from The Still Point Press. 4. Submissions & Editorial Policy Submissions must be made exclusively through our designated online portal and must adhere strictly to our Submission Guidelines. Manuscripts sent via email or post will not be reviewed. All regular submissions are evaluated through a blind review process. Editorial decisions are final, discretionary, and not subject to appeal or individual feedback. 5. Contests & Entry Fees From time to time, The Still Point may run literary contests that require a paid entry fee. All contest entry fees are processed by Gumroad, which acts as the Merchant of Record for these transactions. By paying an entry fee, you enter into a transaction with Gumroad, subject to Gumroad's Terms of Service and applicable consumer protection laws. We do not process, store, or have access to your payment card details. All contests are subject to our Contest Rules, which are published on the contest page and form part of these Terms. 6. Print Orders Physical copies of The Still Point may be ordered through third-party services. These services act as the Merchant of Record for all print orders and are responsible for payment processing, printing, shipping, and customer support. The identity of the specific merchant is disclosed at the point of sale. All transactions are subject to that merchant's terms of service and applicable consumer protection laws. 7. Acceptable Use You agree to use the site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of this site by, any third party. Prohibited behavior includes attempting to breach site security, injecting malicious code, or harassing editorial staff. 8. Disclaimer & Limitation of Liability The website and its contents are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, The Still Point Press shall not be liable for any indirect, incidental, or consequential damages resulting from your use of, or inability to use, this website or its contents. Nothing in these Terms limits any liability that cannot be limited under applicable law. 9. Severability & Modifications If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms. 10. Governing Law & Jurisdiction These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
