The Still Point ("we", "our", or "us"), published by The Still Point Press, London, is committed to protecting your personal data in compliance with the UK GDPR, EU GDPR, and applicable US privacy laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), other applicable US state privacy laws, and the Australian Privacy Act 1988 (Cth). This policy outlines how we collect, use, and safeguard your information. 1. Data Controller For the purposes of data protection legislation, the Data Controller is: The Still Point Press, London, UK. Privacy contact: rights@thestillpoint.press (or via our Contact page). 2. Information We Collect and Why We collect only the minimum personal data necessary to operate our publication: Newsletter Subscriptions: Email address only. Legal basis: Consent. Used strictly to send quarterly updates and issue announcements. We deliver these newsletters directly ourselves. We do not share newsletter subscriber email addresses with Gumroad or any payment processor. You can unsubscribe at any time via the link in any email. Store Orders & Subscriptions: We do not directly collect or store your shipping address, billing address, or payment details. If you purchase a subscription or physical issue through our Gumroad storefront, Gumroad acts as the merchant of record and collects your name, email, payment details, billing address, and shipping address directly from you. We receive only your name and email (and order confirmation) to manage customer support. We never store or see your payment card details. Submissions & Competitions: Name, contact details, author biography, and manuscript files. Legal basis: Legitimate interest / Contract. Used to conduct blind readings, communicate editorial decisions, and manage rights agreements. If a competition requires an entry fee, payment is processed by Gumroad. We do not collect or store your payment or billing information. General Correspondence: Email address and message contents sent to our editorial or administrative inboxes. 3. Categories of Personal Information Collected For residents of California and other US states with comprehensive privacy laws, we disclose the following categories of personal information collected over the preceding 12 months: Identifiers: Name, email address, contact details. Professional or employment-related information: Author biography (for submissions). Commercial Information: We do not directly collect commercial information. Any payment, billing, or shipping information is collected by Gumroad as merchant of record. Internet or Network Activity: Not collected. We do not collect any categories of Sensitive Personal Information (SPI) as defined under the CPRA, including Social Security numbers, precise geolocation, health information, biometric data, racial or ethnic origin, religious beliefs, or sexual orientation. We do not knowingly collect personal information from children under 13. We do not sell or share personal information of consumers under 16 years of age. 4. Cookies and Analytics We operate a privacy-first website: We do not use advertising trackers, cross-site tracking cookies, or third-party behavioral analytics. Essential technical storage (such as saving your preference for light or dark mode) is retained locally in your browser to ensure basic functionality. We honor Global Privacy Control (GPC) signals. If you send a GPC signal via your browser, we will treat it as a valid request to opt out of any sale or sharing of your personal information. Since we do not sell or share your personal information, no further action is required beyond acknowledging your preference. 5. Third-Party Service Providers We do not sell, rent, or trade your personal data. To run our services, we share necessary data only with trusted GDPR-compliant processors, including: Gumroad: We use Gumroad solely for payment processing for contest entries and as the merchant of record for store purchases. Gumroad collects and processes payment, billing, and any shipping information directly from you as an independent data controller. We receive only your name and email address to administer your entry or order. We do not use Gumroad for newsletter delivery, and we do not share newsletter subscriber email addresses with Gumroad. Submission Management Platforms: For processing entries. We do not disclose personal information to third parties for cross-context behavioral advertising or any purpose that would constitute a "sale" or "sharing" under the CCPA/CPRA. 6. International Data Transfers Your personal data may be transferred to, stored, and processed in countries outside your country of residence, including the United States (where Gumroad is based) and the United Kingdom. For EU/UK data subjects: Transfers of personal data from the EU/UK to the United States are protected by appropriate safeguards, including, as applicable, the EU-US Data Privacy Framework (where the recipient is certified), Standard Contractual Clauses (SCCs) approved by the European Commission, and/or the UK International Data Transfer Addendum (IDTA). Our processors, including Gumroad, are contractually obligated to protect your data in accordance with GDPR standards. For Australian data subjects: We comply with Australian Privacy Principle 8 (APP 8) regarding cross-border disclosure of personal information, ensuring overseas recipients protect your data in accordance with APP standards. 7. Automated Decision-Making We do not use automated decision-making technology, including AI-enabled systems, rule-based tools, or automated assessment tools, to make decisions that could reasonably be expected to significantly affect your rights or interests. All editorial decisions regarding submissions are made exclusively by human editors. Accordingly, no personal information is used in the operation of automated decision-making technology, and no decisions are made solely or substantially using such technology. 8. Children's Privacy (COPPA) Our services are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. Because we do not collect personal information from children under 13, we do not maintain a separate children's data retention policy; any inadvertent collection of such data will be deleted promptly. Data Retention We retain personal data only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. Newsletter Data: Retained until you unsubscribe or request deletion. Upon unsubscribing, your email address is deleted from our active mailing list within 30 days. We may retain a suppression record (your email address) to ensure we do not contact you again, as permitted by law. Submissions: Manuscripts and personal details from declined submissions are deleted within 12 months of the editorial decision. For accepted submissions, personal details and manuscripts are retained for the duration of the rights agreement plus 6 years, to comply with legal and accounting requirements. General Correspondence: Retained for 2 years from the date of last correspondence, for administrative purposes. Orders & Contest Payments: We do not retain payment, billing, or shipping information. Any such information is retained by Gumroad as merchant of record (or independent controller) in accordance with its policies and legal obligations. We retain names and email correspondence only as long as necessary to provide support and comply with legal duties. 10. Your Individual Rights UK/EU data subjects: You have the right to request access to, correction of, or deletion of your personal data; request restriction of processing; object to processing based on legitimate interests; and withdraw consent for marketing communications at any time. California residents: Under the CCPA/CPRA, you have the right to know what personal information we collect, request deletion, correct inaccurate details, and opt out of any sale or sharing. You have the right to non-discriminatory treatment for exercising your privacy rights. Residents of other US states: Residents of other US states with comprehensive privacy laws (including but not limited to Virginia, Colorado, Connecticut, Utah, and Texas) may have additional rights, such as the right to opt out of profiling or the processing of sensitive data.
